
The LWVCM’s first LEAGUE TALK for the year is scheduled for Tuesday, September 20 at 6:30 p.m. As in previous years, it will be on the Zoom platform. The event will feature a panel update on the Moore v. Harper case which is scheduled for review by SCOTUS this fall. This case is one so significant that the Brennan Center for Justice has deemed it the “next constitutional crisis.”
The U.S. Supreme Court will decide whether the NC Supreme Court can strike down its legislative gerrymandered map for being in violation of the state Constitution. Two Republican legislators are contesting the NC Supreme Court’s decision to reject the map as “egregious and intentional partisan gerrymander…" and ask that SCOTUS for reinstate the above-mentioned maps. Briefs are being filed over the summer and fall with a probable decision before July 2023.
The legislative briefs are primarily based upon a misinterpretation of an Elections Clause in the Constitution known as the independent state legislative theory which would delegate almost exclusive power to regulate federal elections to the states. At stake is having the NC legislature’s extreme NC partisan gerrymander restored, and the denial for voters across the country of the opportunity to combat this threat in federal or state courts.
The Panelists are Mitchell Brown, Counsel to the Southern Coalition for Social Justice, Rotrina Campbell, a highly skilled civic engagement organizer with Common Cause NC, and community activist, Fair Maps proponent and LWVCM member, Harry Taylor.
