The League strongly encourages all voters eligible to vote by mail to apply for a mail-in ballot rather than waiting.  The elections office will likely be handling a large volume of requests for mail-in ballots.  So registering now will insure that you can check and make sure you are, in fact, registered.

To vote by mail in the rescheduled 2020 Texas Primary Runoff on July 14, the application must be received by no later than July 2 at the Elections Office and the completed ballot returned and received by the Elections Administrator by July 14.

Who can vote by mail in Texas?

  • 65 years or older
  • Sick or disabled
  • Out of the county during early voting and election day. 
  • In jail but otherwise eligible to vote

One of the grounds for voting by mail is disability. The Election Code defines “disability” to include “a sickness or physical condition that prevents the voter from appearing at the polling place on election day without a likelihood of needing personal assistance or of injuring the voter's health.” (Sec. 82.002). Voters who meet this definition and wish to vote a ballot by mail must submit an application for ballot by mail. Texas Secretary of State

The Election Code establishes specific eligibility requirements to obtain a ballot by mail for early voting. TEX.ELEC.CODE §§ 82.001–.004. While any qualified voter is eligible to early vote by personal appearance, the Legislature has limited access to early voting by mail for individuals who meet specific qualifications. Section 82.002 of the Election Code, titled “Disability,” allows a qualified voter to early vote by mail “if the voter has a sicknessor physical condition that prevents the voter from appearing at the polling place on election day without a likelihood of needing personal assistance or of injuring the voter’s health.” See id. § 82.002(a)

The Center for Disease Control (CDC) notes that  people of any age who have serious underlying medical conditions might be at higher risk for severe illness from COVID-19. They provide a list of physical conditions that are known risk factors.
