Amendment to Protect Against Unequal Treatment. This proposal amends Article 1, Section 11 of the New York Constitution. Section 11 now protects against unequal treatment based on race, color, creed, and religion. The proposal will amend the act to also protect against unequal treatment based on ethnicity, national origin, age, disability, sex, sexual orientation, gender identity, gender expression, pregnancy, and pregnancy outcomes, as well as reproductive healthcare and autonomy. The amendment allows laws to prevent or undo past discrimination. There has been considerable mis-and disinformation about Prop 1 on November ballot.
If passed, Prop 1 will :
- Cement the right to abortion in our state constitution
- Make sure the government cannot discriminate against older New Yorkers, pregnant New Yorkers, LGBTQ New Yorkers, or New Yorkers with disabilities when it comes to hiring, promotions, and pay
- Ensure older New Yorkers and those with disabilities have the access they need to vote
- Protectaccess to reproductive healthcare, including abortion, birth control and IVF.
Prop 1 does NOT eliminate anyone’s rights. It does NOT change any laws. What Prop 1 will do is protect all New Yorkers from discrimination giving all of us freedom to control our own lives, futures, and healthcare decisions.
Here is how the proposal will appear on the ballot:
