LWVO submits amicus brief in Montana in support of right to ballot initiative process.
The amicus highlights the attacks on initiative and referendum rights in other states like Ohio and argues that BI-8 is necessary to head off similar attacks on the rights granted to Montanans in our state constitution.

Direct Democracy win in Montana
In January, we told you that we joined an amicus (“friend of the court”) brief [see above] alongside voter protection organizations from other states in support of Montana’s right to the ballot initiative process. This week, the Montana Supreme Court ruled in favor of Montanans Decide, the proponents of BI(Ballot Issue)-8, a citizens initiative that would protect the right to propose and vote on laws using the ballot measure process in Montana.
In its ruling, the Court made clear that procedural rules meant to prevent voter confusion cannot be used as a gatekeeping tool to stop ballot measures before voters see them. Congratulations to the great state of Montana!
