Study of the Federal Judiciary: First National Study In 15 Years Will Add a New Position

At the 2024 LWVUS Convention, delegates voted to embark on a study of the federal judiciary that will lead to formulating a League position by June 2025. The League needs a position from which to advocate on such issues as judicial accountability, transparency, independence, and ethics. While we have positions addressing the US Executive and Legislature, there is none on the third branch of the federal government, the Judiciary. Without a position, the League cannot do advocacy.

Our goal is a position that outlines the values—the standards and norms—the League of Women Voters should use in evaluating proposed changes to policies, laws, and regulations regarding the federal judiciary.

We hope League members find these briefs useful to read and promote discussion of what principles we want the League of Women Voters to use when acting on these issues and on whatever other problems arise.

Remember that as much as we all may want to address specific remedies in our US positions, the position should be principle-based to ensure that it lasts for many years to come and allows us to address a wide variety of issues that may arise in future years. Our goal is for the resulting League position to be durable.

Numerous resources are available at lwv.org including a recorded townhall https://www.youtube.com/watch?v=o0gEKqafpg4 program with speakers representing Brennan Center, Cato Institute and National Women’s Law Center.

Policy papers discuss topics of : Financial Disclosure; Judge Shopping; Judicial Ethics and Enforcement; Legitimacy and the US Supreme Court; Key Terms for the Federal Judiciary Study; Recusal; Representation; Shadow Docket; Stare Decisis and Binding Precedent; Structural reforms for the US Supreme Court

LWVCC will have a MEMBERS MEETING ON WEDNESDAY, MARCH 19 AT 6PM AT THE PORTAGE LAKE DISTRICT LIBRARY to discuss the scope of the consensus questions and our responses to them.

Please plan to participate in this important League project. If you can volunteer to help speak to any aspect of the work, don't hesitate to get in touch with Barry Fink (barryfink [at] chartermi.net).
