Even Year Election Law Upheld
The New York Court of Appeals has upheld the constitutionality of the 2023 Even Year Election Law, which means this law is effective immediately and will impact the terms of local races on the ballot this fall. Anyone running for local office subject to the change this fall would have their terms reduced by one year. Two year positions will have to run again in 2026 and four year positions will run again in 2028. Not all local elections are covered by the change - among others, town justices, county judges, and city and village elections require a constitutional amendment to change their voting cycle. But if you vote in a town election, officials on your ballot will be subject to the shortened term. In New Castle, this means that the town supervisor will be elected for a one year term and the position will be up for election again in 2026 and the town boad members will be elected for a three year term with those seats being up for election again in 2028. Please note the following procedural changes:
New York State voters are no longer permitted to cast a ballot on a voting machine if they have already been issued an early mail, accessible, or absentee ballot for that election. Voters who have already been issued a ballot may cast an affidavit ballot in person, to be counted only if the voter’s early mail, accessible, or absentee ballot has not been received.
If a voter requests a second early mail, accessible, or absentee ballot, any previously issued absentee ballot that is returned by the voter will be set aside. If both ballots are received before the return deadline, the ballot with the later postmark date will be accepted unless the first ballot has already been opened. If a voter submits more than one timely ballot and also casts an affidavit ballot, the last received ballot, either submitted in person during the election or by mail within the absentee return deadline, will be canvassed.
