NewsThe Missouri General Assembly passed HJR 73 on May 14 to have the abortion ban go back to the voters. They say voters didn't understand Amendment 3 but the proposed ballot summary doesn’t mention banning elective abortions. Instead, Missourians would be asked if they want to amend the Missouri constitution to:
- “Guarantee access to care for medical emergencies, ectopic pregnancies, and miscarriages;
- Ensure women’s safety during abortions;
- Ensure parental consent for minors;
- Allow abortions for medical emergencies, fetal anomalies, rape, and incest;
- Require physicians to provide medically accurate information; and
- Protect children from gender transition?”
The legislature also passed SB 22 that would limit the courts' role in approving ballot language. The governor could put the measure on the ballot in 2026 or in a special election.
The proposed Constitutional Amendment would prohibit abortion except in cases of medical emergency, rape or incest, no later than 12 weeks gestational age and only if reported to law enforcement within at least 48 hours of the procedure.It also contains language regarding gender transition and possible prosecution of medical professionals.
"HJR 73 deliberately undercuts the will of the people who worked so hard to get Amendment 3 on the ballot and the voters who passed it," says LWVMO Reproductive Rights Committee Chair Kay Park.
