Delaware's End-of-Life Options Act (HB 140), also known as the Ron Silverio/Heather Block End of Life Options Act, was signed into law in May 2025 and became effective in Delaware on January 1, 2026. This law was championed for many years by then Delaware State Representative Paul Baumbach, and has been the focus of a strong advocacy effort by LWVDE's Advocacy Corps.

What does this mean for the terminally ill in Delaware?

In brief, the law allows terminally ill, mentally capable adult residents with 6 months or less to live to request and self-administer medication to end their lives. It requires extensive safeguards, including two provider confirmations, multiple requests, and waiting periods. It gives terminally ill patients more control over their own end of life, which can be a reassurance even if the choice is never exercised in a given case.
LWVDE hopes that you and your loved ones never need to utilize such an option, but please be aware that this additional end-of-life option now exists in Delaware should you ever find yourself in a position to require it.
