Instagram Reel Contest
- Eligibility: This “Why Vote Video Contest” (the “Contest”) is a contest of skill in making a social media video that illustrates why voting is important.
a. The Contest is open only to Creators (as hereinafter defined) who:
i. Sign up at https://my.lwv.org/missouri/metro-st-louis/why-vote-video-contest (the “Why Vote Video Contest URL”);
ii. Are at least 18 years old as of the date of entry; and
iii. Are registered voters in Missouri and live in St. Louis City, St. Louis County, St. Charles County, Franklin County or Jefferson County
b. Employees and Board Members of the League of Women Voters of Metro St. Louis (“Metro LWV”), its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees and Board Members”), and immediate family members and/or those living in the same household of Employees and Board Members are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations.
2. Agreement to Rules: By participating, you as a Creator (“You”) agree to be fully and unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Metro LWV as final and binding as it relates to this Contest.
3. Why Vote Video Contest Period: Entries will be accepted online starting at 12:00 PM (noon) on 13 October 2024 Central Time and ending at 12:00 PM (noon) on 20 October 2024, Central Time (the “Video Contest Period”). All entries must be received by Metro LWV by email to SecondVP [at] lwvstl.org on or before 9:00 AM on 23 October 2024, Central Time (the “Submission Deadline”).
4. How to Enter: The Contest must be entered by uploading one or more entries to Instagram Reels during the Video Contest Period. The entry must fulfill all Contest requirements (as herein specified) to be eligible to win Two Fifty and 00/00 US Dollars (US$250) (the “Prize”). Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Metro LWV.
5. Prize: The Winner of the Contest (the "Winner") will receive the Prize. Any and all Prize-related expenses, including without limitation, any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. Acceptance of Prize constitutes permission for Metro LWV to use Winner's name, likeness, and entry for purposes of advertising and trade without further compensation.
6. Winner Selection and Notification:Winner Criteria: Winner will be the person who creates a 90-second Instagram Video (Reel) (a “Creator”) that:
a. Has the highest Reach, Engagement Rate, Shares and Saves of Instagram Reels complying with the Contest rules set forth herein during the Video Contest Period.
i. The foregoing data shall be evidenced by screenshots or downloads of statistics from extended data and analytics for each video entry in this Contest for Reels posted on Instagram. Such statistical screenshots and downloads shall be submitted to the Metro LWV at SecondVP [at] lwvstl.org by the Submission Deadline. Metro LWV shall notify each Creator by email of receipt of entry by email on or before 5:00 PM on 25 October 2024. If a Creator does not receive such notification, any such Creator shall be solely responsible for contacting Metro LWV about any such missing entry by email or phone call to 314-961-6869 on or before 9:00 AM on 26 October 2024.
b. Provides compelling reasons why voting is important, what voting can accomplish and why voting is not only a right, but also a responsibility of every citizen of the United States.
c. Produces a video that is non-partisan (does not endorse any candidate or position on any issue), not obscene, does not state or imply the approval or endorsement of Metro LWV or its successors, assigns or affiliates, is factually true, and does not discriminate or degrade anyone on the basis of gender or sexual identity, race, creed, religion or physical condition.
d. Tags Metro LWV on any Why Vote entry uploaded to Reels on Instagram;
e. At minimum uses the following hashtags: #votemissouri, #lwvmetro, #whyvote
f. Within ten (10) days after being notified of winning the Contest, provides
i. Proof that the Creator is at least 18 years of age as of the time of entering the Contest,
ii. A written consent from each person seen in the winning video for his or her likeness to be used in the video and agreeing to all the terms of the Contest, as set forth at https://my.lwv.org/missouri/metro-st-louis/video-consent.
iii. Discloses if all or any portion of the video is produced or created by AI.
7. Winner Notification: Winner will be notified by email on or before 11 November 2024. Metro LWV shall have no liability for Winner's failure to receive notices. If Winner (a) cannot be contacted, and/or (b) is ineligible, and/or (c) within 20 days after the date and time award notification was sent, fails to claim the Prize and submit the documents required under Section 6, the Prize shall be forfeited and an alternate Winner selected. Receipt by Winner of the Prize is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT METRO LWV’S SOLE DISCRETION) WILL RESULT IN WINNER'S DISQUALIFICATION AS WINNER OF THE WHY VOTE VIDEO CONTEST, AND ALL PRIVILEGES AS WINNER SHALL BE IMMEDIATELY TERMINATED AND THE PRIZE RETURNED TO METRO LWV.
8. Rights Granted by You: By entering the Contest, You understand and agree that Metro LWV, anyone acting on behalf of Metro LWV, and Metro LWV’s licensees, successors, and assigns, shall have the right to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent. By entering this Contest, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Metro LWV. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Metro LWV from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which METRO LWV may incur, suffer, or be required to pay arising out of, or related to or connected with, such infringement or suspected infringement of any third party’s right.
9. Terms & Conditions: Metro LWV reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Metro LWV’s control, corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, Metro LWV may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Metro LWV. Metro LWV reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Why Vote Video Contest or website or violates these Terms & Conditions. Metro LWV has the right, in its sole discretion, to maintain the integrity of the Why Vote Video Contest, to void votes for any reason, including, but not limited to: the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Why Vote Video Contest may be a violation of criminal and civil laws. Should such an attempt be made, Metro LWV reserves the right to seek damages to the fullest extent permitted by law.
10. Limitation of Liability: By entering the Contest, You agree to release and hold harmless Metro LWV and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant's participation in the Why Vote Video Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
11. Disputes: THIS CONTEST IS GOVERNED BY THE LAWS OF THE STATE OF MISSOURI WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Why Vote Video Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Missouri having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including attorney fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Why Vote Video Contest). Participant further waives all rights to have damages multiplied or increased.
12. Winner: To obtain a copy of the Winner's name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to Metro LWV, 8706 Manchester Rd #104, St. Louis, MO 63144. Requests must be received no later than 1 January 2025.
13. Sponsor: The Sponsor of the Why Vote Video Contest is Metro LWV, 8706 Manchester Rd #104, St. Louis, MO 63144.
14. Heirs, Personal Representatives, Executors, Successors and Assigns. This Agreement shall be binding on any and all persons or organizations connected with, affected by, controlled by or otherwise related to any such persons or organizations and their respective, heirs, personal representatives, successors and assigns.
This Agreement is hereby entered as of the ______________________________ 2024 by and between League of Women Voters of Metro St. Louis and _________________________________________ (Winner).
