April 14 vote: Senate version of H.4756 substitutes "Porta Potty" for a single user bathroom

Please call your House member and ask them to vote not to concur with the Senate version of H.4756. This vote is scheduled for April 14.

The House passed a version H. 4756 that requires that trans persons use public school restroom and changing facilities associated with the gender assigned at their birth. This bill is not needed, but the harm is partially mitigated by a requirement that public school buildings include a single user facility that is open to persons of any gender.

The Senate version allows schools to substitute an outdoor portable restroom (“Porta Potty”) for that single user facility. Both trans children and adults would have to go outdoors for a restroom while everyone else uses standard indoor facilities.

H.4756 also adds a private right of action that would allow persons to bring lawsuits if they believe they have been compelled to share facilities with someone not of their gender.

Non-concurrence in the House would send this bill to a conference committee where these very harmful provisions can be removed.
